We have recently experienced some situations with new tenants applying for properties saying that they have not been asked for documents to support Right to Rent requirements in the past! This is quite worrying and surprising. We thought it worthwhile just popping a reminder here of the penalties involved in non-compliance. These penalties increased significantly in February this year!
Fines for non-compliant landlords are (since February 2024) £5000 per lodger and £10,000 per occupier for first time offences. For repeat offences, penalties increase to a maximum of £10,000 per lodger and £20,000 per occupier, a significant increase from the prior thresholds of £500 and £3000!
If you are a landlord using an agent for your ‘tenant find’ or ‘management’ services this should be included in your package, however if you are a landlord with tenants or looking for tenants for your property, this is your responsibility to know what the requirements are to complete them correctly.
Unlimited Right to Rent applies to certain groups including British citizens, Irish citizens, and individuals with settled status. All others fall into the category requiring these checks. We have included the link here for ease Landlord's guide to right to rent checks - GOV.UK (www.gov.uk).
