DO YOU NEED YOUR TENANT TO LEAVE?

I hope you never have any trouble with a tenant but sometimes things go wrong and nowadays you MUST follow the correct procedure to remove a tenant or it could cost you LOTS of money and time. MOST importantly everything needs to be in place at the very start of the tenancy.

Here is EVERYTHING you currently need to evict a tenant under a Section 21 notice (2 months):

  • The correct, up-to-date, relevant Section 21 notice (Form 6a).
  • The correct AST (assured shorthold tenancy) contract, completed fully and correctly (good practise to use tenants FULL names)
  • The deposit registered within 30 days of the AST start date.
  • The correct, up-to-date, relevant ‘How to Rent’ guide.
  • The correct, up-to-date, relevant Right to Rent checks.
  • The correct, up-to-date, relevant Gas Safety Certificate.
  • The correct, up-to-date Electrical Installation Condition Report (EICR)
  • The correct, up-to-date, relevant Energy Performance Certificate (EPC)
  • The correct, up-to-date, relevant licenses (if applicable) for renting your particular property.

Remember you cannot serve the notice if you have been issued an order to do repairs under an ‘Improvement Notice’ or an ‘Emergency Works Notice’ by the Council, you must wait a full 6 months after all the works have been completed.

Remember, you can use a Section 8 instead, if your tenant is in rent arrears which has a shorter vacating date, dependant on the grounds you use.
